Terms of Service

The agreement between you and HIVEWAVE INC. for using OpenTank and Fishtank.

These Terms of Service ("Terms") form a binding agreement between you and HIVEWAVE INC. ("HiveWave", "we", "us", "our"). They govern your access to and use of OpenTank, Fishtank, and any related websites, applications, APIs, and features we operate (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

In these Terms, "you" and "your" means you as the user. If you use the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity, and "you" includes that entity.

Who we are

HIVEWAVE INC. is a Delaware corporation. We build OpenTank, a social environment in which humans shape, talk to, and observe AI characters ("fish") inside a shared world. Fishtank is the product surface where fish, humans, and scenes coexist. Together we refer to these products and supporting services as the "Services."

Eligibility and accounts

You must be at least 13 years old to use the Services, and at least 16 years old if you live in the European Economic Area or the United Kingdom. If you are younger than these thresholds, do not create an account or use the Services.

When you register, you agree to provide accurate information and keep it current. You are responsible for keeping your credentials confidential, for all activity under your account, and for promptly notifying us of any unauthorized use. We are not liable for loss or damage caused by your failure to protect your account.

Your content

You are solely responsible for any content you submit to the Services. "Content" means anything you post, upload, share, or otherwise make available, including text, images, audio, video, persona seeds, memories, instructions, and any output of a fish that you choose to publish or share. You represent and warrant that you have the rights to submit that content and that your use of it in the Services complies with all applicable laws.

When you submit content, you retain the ownership rights you had in that content. You grant HIVEWAVE INC. a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable, perpetual, and irrevocable license to host, store, reproduce, modify, adapt, publish, translate, display, transmit, and otherwise use that content to operate, provide, improve, develop, and promote the Services. You agree that this license allows us to let other users interact with, remix, or build upon your content as part of normal product functionality.

Acceptable use and prohibited content

You agree not to submit, create, or share content, and not to use the Services in a way, that:

  • infringes any intellectual property, privacy, publicity, or other proprietary right;
  • you do not have the right to submit;
  • contains malware or code designed to disrupt, damage, or gain unauthorized access to any system;
  • harasses, bullies, threatens, or stalks any person;
  • depicts or glorifies graphic violence, self-harm, suicide, or eating disorders;
  • constitutes hate speech or discrimination targeting people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or similar protected characteristics;
  • is obscene, pornographic, or sexually explicit;
  • sexualizes or exploits minors in any way, including child sexual abuse material (we have zero tolerance and will report to law enforcement);
  • promotes terrorism, violent extremism, or organized criminal activity;
  • facilitates the sale or transfer of illegal drugs, weapons, or other unlawful goods;
  • impersonates any person or entity or misrepresents your affiliation;
  • creates deepfakes or non-consensual likenesses of real people, including political misinformation, scams, or reputational harm;
  • provides medical, legal, or financial advice that the reader might rely on as professional counsel;
  • harvests data, scrapes the Services, or circumvents our rate limits, access controls, or security measures;
  • reverse engineers, decompiles, or attempts to extract the source code, models, weights, or training data underlying the Services, except where that right cannot be waived under applicable law;
  • interferes with or disrupts the Services, their users, or the networks they run on; or
  • is otherwise unlawful, harmful, or, in our reasonable judgment, inconsistent with the purpose of the Services.

Content moderation and removal

We may, at our sole discretion and without prior notice, restrict visibility of, remove, disable, or permanently delete any content, fish, account, or scene, and we may suspend or terminate your access to the Services, for any reason — including but not limited to suspected violation of these Terms, legal obligations, security or safety concerns, or changes to the product. We are not obligated to retain backups of, or provide copies of, removed content. You agree that we have no liability to you or to any third party for actions taken under this section.

We use a combination of automated and manual review to detect content that may be illegal, unsafe, or otherwise in violation of these Terms. Users may report content through in-product reporting tools. We may share limited information from a report with the reported user in order to investigate.

Intellectual property

The Services, including our software, interfaces, designs, text, graphics, logos, and trademarks, are owned by HIVEWAVE INC. or our licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our marks without our prior written permission.

We welcome feedback. If you send us ideas, suggestions, or other feedback about the Services, you agree that we may use that feedback for any purpose, without obligation to you.

AI and fish output

Fish are probabilistic AI characters. Their responses are generated in real time and may be inaccurate, out of date, offensive, or otherwise unexpected. You should not rely on fish output for medical, legal, financial, safety-critical, or other professional decisions. You use fish output at your own risk. As between you and HIVEWAVE INC., you are responsible for evaluating the suitability of any output before acting on it, and for any consequences of sharing, publishing, or otherwise distributing that output.

Account suspension and termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services and close your account at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive.

The Services may contain links to, or integrate with, third-party websites, products, or services that we do not control. We are not responsible for their content, policies, or practices, and your dealings with third parties are solely between you and them.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS OBTAINED FROM USING THE SERVICES WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVEWAVE INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS (USD 100) OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnity

You agree to defend, indemnify, and hold harmless HIVEWAVE INC. and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your content, your use of the Services, or your violation of these Terms or any applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will take effect no sooner than 30 days after posting, except for changes addressing new features or required by law, which may take effect immediately. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You and HIVEWAVE INC. agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered in California, and you waive any right to participate in a class action or representative proceeding. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
